US: Kluge, Moses sue over foreclosure, auction

Patricia Kluge, William Moses and their Kluge Estate Winery business have sued the bank that foreclosed on the winery and sold it at auction, claiming the bank engaged in “flawed and wrongful conduct” that damaged the business.
In a suit filed last week in the U.S. District Court in Charlottesville, the couple accuses Farm Credit of the Virginias and its subsidiary, Gran Cru Properties, of wrongful conduct before and after the winery foreclosure.
The suit seeks compensatory damages for money lost and asks for treble damages, a punitive award equal to three times the actual damages, with the amounts to be set at a jury trial.
